Your Background Check Rights

A Summary of Your Rights Under the Fair Credit Reporting Act · Last updated: September 22, 2026

Why you are reading this. ZeroTow runs a criminal background check and a motor vehicle record check on every driver applicant, and repeats them periodically. Those checks are carried out for us by a third-party screening company, which the law calls a consumer reporting agency. Federal law gives you specific rights whenever a company does that, and requires us to hand you this summary. You also receive the official version from the Consumer Financial Protection Bureau, together with a separate disclosure and authorization form, at the time you apply and at each re-screening.

What the law gives you

You must be told if information in your file was used against you

If we decline your application, deactivate you, or take any other adverse action based even in part on a background or driving report, we must tell you, and give you the name, address and phone number of the company that supplied it.

You have the right to know what is in your file

You may ask the screening company for everything it holds on you. Identification is required. The disclosure is free if: we have taken adverse action against you because of it, and you ask within 60 days; you are the victim of identity theft and there is fraudulent information in your file; your file contains inaccurate information as a result of fraud; you are on public assistance; or you are unemployed but expect to apply for work within 60 days. Everyone is also entitled to a free report from each nationwide agency once every 12 months.

You have the right to dispute incomplete or inaccurate information

If you tell the screening company that your file contains something incomplete or inaccurate, it must investigate, usually within 30 days, unless your dispute is frivolous.

Inaccurate, incomplete or unverifiable information must be corrected or deleted

A screening company may not keep reporting information it cannot verify, in most cases within 30 days of your dispute. It is not required to remove accurate information unless the information is outdated (see below) or cannot be verified.

Outdated negative information may not be reported

In most cases a screening company may not report negative information that is more than seven years old, or bankruptcies more than ten years old.

Access to your file is limited

A screening company may give information about you only to people with a valid need — usually to consider an application with a creditor, insurer, employer, landlord or other business. An employer or prospective employer, which includes ZeroTow in this context, needs your written consent.

Your consent is required, and you may withdraw it

We may not obtain a report about you for this purpose without your written authorization. You may refuse, and you may withdraw a previously given authorization at any time by writing to info@zerotow.com. Refusing or withdrawing consent means we cannot complete or maintain your approval as a ZeroTow driver, because we cannot verify the checks the platform and our insurers require — but the decision is yours, and it is not held against you in any other way.

You may seek damages

If a screening company, or anyone who supplies information to one, or anyone who uses a report, violates the Fair Credit Reporting Act, you may be able to sue in state or federal court.

Identity theft victims and active duty military personnel have additional rights

These include the right to place a fraud alert or an active duty alert on your file. Details are in the official CFPB summary.

What ZeroTow checks, and when

Before we take adverse action on the basis of a report, you will receive a copy of the report and this summary, and a reasonable opportunity to dispute what it says with the screening company before any final decision is made.

If something looks wrong

Dispute the contents of a report with the screening company that produced it — their name and contact details are on the notice we send you, and they are the only party that can correct their own file.
